CBD laws were vague for a long time. Even after hemp was legalized in Texas, some counties didn’t take kindly to CBD possession and vowed to prosecute anyone caught with CBD, no matter how low the THC amount. We thankfully have laws on the books now that specify what’s legal and what isn’t. (Spoiler alert: It’s now legal to possess CBD with up to 0.3% THC anywhere in Texas.) At Your CBD Store in Keller, we want to make sure our customers know their rights and know the laws regarding cannabis and hemp-derived products in the DFW Metroplex.

Low-THC CBD (0.3% THC or Less)

This is the kind of CBD we carry in our store and online. It does not produce a high or alter your mental state. It’s legal to take it anywhere in Texas, including on mass transit systems like airplanes and rails. The more subtle dosing systems like candies or water additives can be used anywhere, but vaping might be prohibited in certain areas. Adults are totally within the law if they are carrying 0.3% THC CBD.

One reason to choose Your CBD Store in Keller over any other retailer is because all our products are independently lab tested to prove they contain a legal amount of THC. We make the test results available to the public at this website and in our store. You never have to worry about having a product that contains too much THC when you shop with us!

Medical CBD (0.5% THC or Less)

Texas has strict regulations on the possession of medical-grade CBD that contains up to 0.5% THC. Though the Compassionate Use Act allows specialist physicians to prescribe medical CBD for a larger range of conditions, both the patient and the doctor still have to jump through multiple hoops before possession of this CBD can be considered ‘legal’.

The act specifies that a physician with an appropriate specialty may prescribe 0.5% THC CBD for patients suffering from the following conditions:

  • epilepsy and other seizure disorders
  • autism
  • multiple sclerosis
  • spasticity
  • ALS and other neurodegenerative diseases
  • terminal cancer

If you’re caught with medical CBD, be prepared to show the officer your prescription at the very least.

Marijuana

Marijuana is still illegal throughout Texas, with one exception: If you suffer from intractable epilepsy and two doctors recommend marijuana to ease your symptoms, you may legally be prescribed medical marijuana. It’s difficult to find a doctor qualified to prescribe it in Texas, but it’s possible. If you carry your medical marijuana with you, you should also carry your prescription and your doctor’s contact information, just to be safe.

Now that hemp is legal in Texas, many of the larger counties (such as Dallas County) have chosen not to arrest most people caught with less than 4 oz in their possession. They are ticketed instead, but may still get jail time if found guilty of the offense. Other counties, like Tarrant County, have vowed to prosecute every marijuana possession case.

The Bottom Line

If your CBD products contain 0.3% or less THC, they’re legal throughout Texas. If you are carrying medical-grade CBD with up to 0.5% THC, you’re still legal if you can prove you have a valid prescription for it. You can be arrested for carrying any amount of marijuana at any time, but big cities are less likely to arrest you for possession of less than 4 oz. Use your best judgement in these situations.
